Terms of Service

1. Acceptance of Terms

By registering for an account, accessing the SurroundIQ administrative dashboard, utilizing the SurroundIQ REST APIs, or embedding the SurroundIQ JavaScript SDK on any digital property, you (“Customer” or “You”) agree to be legally bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Service License & Permitted Use

SurroundIQ grants Customer a non-exclusive, non-transferable, revocable license to access our platform and deploy our embeddable widgets on verified website domains under Customer’s authorized subscription plan.

• Verified Domain Requirement: Customer agrees to embed the SDK only on domains verified through DNS records or HTML meta-tag verification within the dashboard.
• Property Limits: Each subscription plan enforces a maximum quota of concurrently active property listings. Exceeding property quotas requires plan upgrade.
• No Reverse Engineering: Customer shall not decompile, reverse engineer, or extract proprietary ingestion logic or data enrichment pipelines.

3. Data Accuracy & Spatial Information

SurroundIQ synthesizes geographical insights, transit timings, and nearby points of interest from third-party geospatial providers (including OpenStreetMap contributors and meteorological models). While we strive for high precision and continuous cache freshness:

• Commute times, walking calculations, and public amenity operational statuses are approximations provided for informational purposes only.
• SurroundIQ is not responsible for municipal boundary rezonings, school district boundary shifts, or commercial establishment closures not yet updated in public registers.

4. Fees, Billing & Upgrades

Paid subscriptions are billed on a recurring monthly or annual basis. Accounts that fail to maintain a valid payment method after a grace period of 7 business days may be temporarily suspended until billing is resolved. Trial periods automatically transition to selected plans upon expiration unless canceled prior to the trial conclusion.

5. Intellectual Property

SurroundIQ retains all rights, title, and interest in and to the SurroundIQ platform, widget design architecture, algorithmic caching pipelines, and trademarks. Customer retains all rights to their proprietary listing listings, brand marks, and customer-generated leads.

6. Limitation of Liability

To the maximum extent permitted by applicable law, SurroundIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, real estate transactions, or data loss arising from or related to the use of our widget or APIs. SurroundIQ’s aggregate liability shall not exceed the amount actually paid by Customer in the twelve (12) months preceding the claim.

7. Termination

Customer may cancel their subscription at any time via the billing management tab. SurroundIQ may suspend or terminate service immediately if Customer violates acceptable use guidelines, attempts unauthorized API scraping, or deploys the SDK to malicious or non-verified domains.
